This proposed rule, grounded in the Supreme Court’s Bostock v. Clayton County decision, defines sex-based harassment to include sexual orientation and gender identity. It encompasses actions like misgendering, epithets, and denial of access to gender-appropriate facilities. Additionally, the rule addresses religiously motivated harassment but notes that employers should act against it before it creates a hostile work environment. Despite this move, a majority of voters disagree with making incorrect pronoun use illegal, and federal courts have previously protected employees’ freedom of speech regarding such matters.
