Biden’s DOJ Challenges Florida Law Restricting Chinese Land Ownership

The Biden administration has filed a statement of interest in a lawsuit challenging a new Florida law that prohibits Chinese citizens from owning land in the state. The Department of Justice (DOJ) argued that the law violates the Equal Protection Clause of the 14th Amendment and the Fair Housing Act. The plaintiffs in the case are Chinese citizens residing in Florida who operate brokerage businesses. Florida Governor Ron DeSantis (R) criticized the DOJ’s stance and stated he supports the American people and will continue to prohibit CCP-tied entities from buying land in Florida. The law also applies to citizens of other “countries of concern.” However, the measure only applies to foreign citizens that are domiciled in one of these countries. Also, the law does not affect foreign citizens that hold a U.S. citizenship or are permanent residents.
