Federal Judge Upholds West Virginia Law Protecting Girls Sports

Southern District of West Virginia Judge Joseph R. Goodwin has ruled in favor of West Virginia H.B. 3293, the Save Women’s Sports Act, which separates sports based on biological sex. Goodwin, a Clinton-appointee, said, “I do not see how I could find that the state’s classification based on biological sex is not substantially related to its interest in providing equal athletic opportunities for females.” The ruling flies in the face of an executive order signed by President Biden calling on schools to allow transgender athletes to compete in sports based on their “gender identity” rather than their biological sex.  Alliance Defending Freedom (ADF) Senior Counsel Christiana Kiefer called the ruling “a win for reality.”
