Trump-era border policy “Title 42” will remain in effect following a 5-4 vote by the U.S. Supreme Court. Additionally, the Court has agreed to hear oral arguments and rule on whether individual states can intervene, pending a decision by the end of June. The policy was invoked under former President Donald Trump in March of 2020 amid the COVID pandemic on the grounds of keeping contagious diseases out of the U.S. A previous ruling by Democrat judge Emmet Sullivan, who said the policy is “arbitrary and capricious,” will be upended by the Supreme Court’s recent ruling.
