Although lacking constitutional authority to do so, the January 6 Committee is asking the Department of Justice (DOJ) to prosecute former President Donald Trump as their investigation wraps up on Monday. Congressional committees may organize for a legislative purpose, but are not authorized to organize for law enforcement action — this is a function of the executive branch under separation of powers in the Constitution. Rep. Adam Schiff (D-CA), who perpetuated lies regarding the evidence of “Russian Collusion,” with the other committee members are calling for charges against Trump of “insurrection, obstruction of an official proceeding, and conspiracy to defraud the federal government.”
